"Self-determination" & "no distinction" are UN Fundamental Human Rights!! 自決 和 無區別 是聯合國基本人權和香港的義務!

International Covenant on Civil & Political Rights (ICCPR) "Preamble":

"..Recognizing that, in accordance with the Universal Declaration of Human Rights, the ideal of free human beings enjoying civil and political freedom and freedom from fear and want can only be achieved if conditions are created whereby everyone may enjoy his civil and political rights, as well as his economic, social and cultural rights,.."



HK has a lot of "fear" & "wants"!


The current grovelling sycophantic HK Legislators and HK Governments illegal interventionist directives (under the "Basic Law") of the Chinese Communist Party (CCP) is only making the current HK situation much worse for the majority of HK people!


Examples include high speed rail terminus, retroactive oath taking, prosecution of Occupy Leaders, missing Causeway Bay booksellers, failure of due process in ex-CE C.Y. Leung's investigation for corruption, etc.


HK has been ranked for the last 8 years as having the worlds most "unaffordable" housing and as a city is rated 2nd (behind New York, USA) as having the highest gap between rich and poor! Roughly 20% of HK people are classified as "poor" with more than 70,000 households going to bed hungry every night. These are fundamental human right under ICESCR.


Perhaps by "intent" HK's "Basic Law" - unlike most Constitutions - does NOT have a mechanism in which it's UN obligations automatically apply therefore requiring HK to enact "local legislation" - which it rarely does!


Under HK's United Nations (UN) obligations HK must ensure 100% legislation, policies & practices to the International Convenant on Civil & Political Rights (ICCPR). Currently HK does NOT comply 100% with ICCPR!


Just prior to the 1997 British Handover of HK to China (under the Sino-British Joint Declaration, lodged with the UN) the Legislative Council (LegCo) passed the "Hong Kong Bill of Rights Ordinance" (HKBORO) which is missing ICCPR Articles 1 and 20!


Under ICCPR HK is obliged to have "democratic Universal Suffrage" NOT the the current socioeconomic-political Chinese Feudal Plutocracy which is stifling all aspects of HK for the majority of HK people.


ICCPR Article 1.1 states that "all peoples have the right to self-determination" - which according to UN is a fundamental human right - is currently being denied to HK people in all aspects of our lives including the PRC promised "Universal Suffrage."


The complete denial of HK's UN obligations to the "progressive" implementation of International Covenant on Economic, Social & Cultural Rights (ICESCR) means that HK has failed to comply with it's obligation to ICCPR Article 1.1.


HK has not accepted UN recommendations of comprehensive anti-discrimination legislation nor the forming of an independent third party human rights watchdog.


HK has NOT legislated into HK law ICCPR Article 20. HK Chinese language Press and some Politicians have publicly incited racial hatred especially against minorities targeting South Asian communities.


If HK wants to become "Asia's World City" and become a vibrant international "financial center" it must have the best rule of law in Asia - which it can not because above the Judiciary is the interventionist Chinese Communist Party political body of the National Peoples Congress!


HK does not have an "independent" judiciary as required under the Joint Declaration and under ICCPR.


There are currently only two World Cities being New York, USA and London, UK. They have a highly developed rule of law, democracy and use English language.



Article 1

"1. All peoples have the right of self-determination. By virtue of that right they freely determine their political status and freely pursue their economic, social and cultural development.

2. All peoples may, for their own ends, freely dispose of their natural wealth and resources without prejudice to any obligations arising out of international economic co-operation, based upon the principle of mutual benefit, and international law. In no case may a people be deprived of its own means of subsistence.

3. The States Parties to the present Covenant, including those having responsibility for the administration of Non-Self-Governing and Trust Territories, shall promote the realization of the right of self-determination, and shall respect that right, in conformity with the provisions of the Charter of the United Nations."


Article 2

"1. Each State Party to the present Covenant undertakes to respect and to ensure to all individuals within its territory and subject to its jurisdiction the rights recognized in the present Covenant, without distinction of any kind, such as race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status.

2. Where not already provided for by existing legislative or other measures, each State Party to the present Covenant undertakes to take the necessary steps, in accordance with its constitutional processes and with the provisions of the present Covenant, to adopt such laws or other measures as may be necessary to give effect to the rights recognized in the present Covenant.

3. Each State Party to the present Covenant undertakes:

(a) To ensure that any person whose rights or freedoms as herein recognized are violated shall have an effective remedy, notwithstanding that the violation has been committed by persons acting in an official capacity;

(b) To ensure that any person claiming such a remedy shall have his right thereto determined by competent judicial, administrative or legislative authorities, or by any other competent authority provided for by the legal system of the State, and to develop the possibilities of judicial remedy;

(c) To ensure that the competent authorities shall enforce such remedies when granted."


Article 20

"1. Any propaganda for war shall be prohibited by law.

2. Any advocacy of national, racial or religious hatred that constitutes incitement to discrimination, hostility or violence shall be prohibited by law."




“自決(Self-Determination)”和“無區別(No Distinction)”是聯合國基本人權和香港的義務!

國際公民權利和政治權利國際公約(ICCPR)“序文”:

“......認識到,根據”世界人權宣言“,只有創造條件,使每個人都享有公民權利和政治權利,才能實現自由人享有公民和政治自由以及免於恐懼和匱乏的自由的理想。 ,以及他的經濟,社會和文化權利,......“

香港有很多“恐懼”和“慾望”!

目前卑躬屈膝的香港立法會議員和香港政府的非法干預主義指令(根據中共的“基本法”),只會令香港大多數香港人目前的情況更糟糕!

例如高速鐵路終點站,反動的誓言,起訴“佔中”領袖,消失的銅鑼灣書商,以及前CE C.Y Leung貪污案的調查等

過去8年來,香港一直被評為擁有世界上最“負擔不起”的住房,而且作為一個城市被評為第二名(僅次於紐約)的貧富差距最大的城市!大約20%的香港人被列為“窮人”,每晚有超過70,000戶家庭餓著肚子上床睡覺。這些是ICESCR下的基本人權。

或許在“意圖”上,香港的“基本法”與大多數憲法不同,沒有一種聯合國義務自動適用的機制,因此香港需要製定“地方立法” - 香港很少這樣做!

根據香港的聯合國(UN)義務,香港必須確保國際公民權利和政治權利國際公約(ICCPR)100%的立法,政策和做法。目前香港100%不遵守ICCPR !
